These Terms & Conditions apply to purchases made through the Blue Vanilla Designs website. Please read them carefully before placing an order.

1. About these terms
These Terms & Conditions set out the basis on which we supply products to you through the Blue Vanilla Designs website.
By placing an order, you confirm that you have read and agree to these terms.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
2. Our products
Blue Vanilla Designs supplies edible cake and cupcake toppers, including personalised products and products created using customer-supplied photographs, artwork, wording or designs.
Our products are made and printed to order.
- colours shown on a screen may differ slightly from the finished printed product;
- edible printing may produce different results from printing on ordinary paper;
- icing sheets and wafer paper differ in colour intensity, texture, flexibility and transparency;
- slight variations in positioning, colour or finish may occur between individual products.
These normal variations are not considered faults.
3. Personalisation
Many of our products are personalised using information supplied by you, such as a name, age, date, message or other wording.
Please check all personalisation carefully before submitting your order.
We print wording exactly as it is submitted, including spelling, grammar, punctuation and capitalisation. We do not routinely correct or alter customer-supplied wording.
You are responsible for ensuring that the personalisation information you provide is accurate.
If you notice an error after placing your order, please contact us as quickly as possible at hello@bluevanilladesigns.com.
We will try to make changes where production has not yet begun, but we cannot guarantee that changes will be possible once an order is being prepared or printed.
4. Customer-supplied photographs, artwork and designs
If you order a Design Your Own product or otherwise provide us with a photograph, image, logo, design or artwork, you confirm that you have the right or permission to use that material for the purpose requested.
You must not knowingly submit material that:
- infringes another person's copyright, trademark or other intellectual-property rights;
- is unlawful;
- is defamatory;
- contains illegal content; or
- you do not have permission to reproduce.
We reserve the right to refuse or cancel an order where we reasonably believe that supplied material may be unlawful, infringing, unsuitable for reproduction or technically unusable.
Where an uploaded image is low resolution, blurred, badly cropped or otherwise unsuitable, the quality of the finished edible print may be affected.
We will reproduce customer-supplied artwork as closely as reasonably possible, but we cannot guarantee improvements to poor-quality source files.
5. Placing an order
When you submit an order through our website, you are making an offer to purchase the products shown in your order.
Your order is accepted when we send confirmation that we have accepted the order.
We reserve the right to refuse or cancel an order before production where, for example:
- a product is unavailable;
- there has been an obvious pricing or website error;
- we are unable to fulfil the requested personalisation;
- artwork supplied cannot reasonably be used;
- payment has not been authorised; or
- we reasonably believe the order would require us to reproduce unlawful or infringing material.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product.
6. Prices and payment
All prices are displayed in pounds sterling (GBP).
Creative Munch Ltd is not currently registered for VAT, so VAT is not added separately to our prices.
Payment may be made using the payment methods offered at checkout, which may include:
- debit or credit card payments processed through Stripe; and
- PayPal.
Payment must be authorised before we begin processing your order.
We do not intentionally store your full payment-card details on our own website systems.
7. Processing and dispatch
Our edible toppers are prepared and printed to order.
Any processing or dispatch times shown on the website are estimates and may vary during busy periods.
We aim to prepare orders as quickly as reasonably possible but cannot guarantee a specific dispatch date unless we have expressly agreed one with you.
Once an order has entered production, it may no longer be possible to amend or cancel it.
8. Delivery
Orders are sent using the delivery options shown at checkout. Delivery may be provided by Royal Mail or another postal or courier service.
Estimated delivery dates are estimates rather than guaranteed dates unless expressly stated otherwise.
We are not responsible for delays caused by events outside our reasonable control, such as:
- postal or courier disruption;
- strikes;
- severe weather;
- transport disruption;
- customs delays where applicable; or
- other exceptional circumstances.
Please ensure that the delivery address supplied when placing your order is complete and correct.
If an order is returned to us because an incorrect or incomplete address was provided, additional postage charges may apply before it can be resent.
9. Cancellations and change-of-mind returns
Most products sold by Blue Vanilla Designs are personalised, made to the customer's specifications and/or edible products with a limited shelf life.
The normal cancellation right that applies to many online purchases does not apply in certain circumstances, including where goods are made to a consumer's specifications or are clearly personalised, and where goods are liable to deteriorate or expire rapidly.
Accordingly, we do not normally accept change-of-mind returns or cancellations for personalised or perishable edible toppers once production has begun.
If you contact us before production starts, we will do our best to accommodate a change or cancellation where reasonably possible, but we cannot guarantee that this will be possible.
This section does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.
10. Faulty, damaged or incorrect products
We want you to be happy with your order.
If your product arrives damaged, is faulty, is not as described or we have made an error in producing your order, please contact us as soon as reasonably possible at hello@bluevanilladesigns.com.
Please include your order details and, where helpful, photographs showing the problem.
Under the Consumer Rights Act 2015, goods supplied to consumers must be of satisfactory quality, fit for purpose where applicable, and match their description.
Where appropriate, we will offer a suitable remedy, which may include a replacement or refund.
Your statutory rights are not affected by the personalised or edible nature of the product.
11. Edible product information
Our products are edible decorations intended for use on cakes and cupcakes.
Product information, including ingredients and allergen information, will be provided where required.
Our toppers may be printed on materials including:
- icing sheets; and
- wafer paper.
The characteristics of these materials differ. For example, icing sheets generally produce brighter colours and a smoother finish, while wafer paper may be slightly translucent and produce softer colours.
Where stated, our edible topper materials are suitable for vegetarians and vegans.
Our products are produced in an environment that handles allergens. We therefore cannot guarantee that products are completely free from traces of allergens.
Customers with allergies or intolerances should check the ingredient and allergen information provided before consuming the product.
12. Storage
To maintain product quality, please follow the storage instructions supplied with your order.
Unless otherwise stated, edible toppers should generally be:
- kept sealed in their original packaging until required;
- stored somewhere cool and dry;
- kept away from direct sunlight and moisture; and
- not refrigerated or frozen where the supplied instructions advise against doing so.
We cannot accept responsibility for deterioration caused by incorrect storage after delivery.
13. Applying your topper
Please follow the application instructions supplied with your product or shown on our How to Apply page.
Some toppers require cutting before use, and icing sheets may require removal from a backing sheet.
The finished appearance of an edible topper can be affected by the cake surface, moisture, temperature and method of application.
We cannot be responsible for damage caused by incorrect cutting, storage or application after the product has been delivered in satisfactory condition.
14. Colours and printed appearance
The colours displayed on your computer, tablet or phone may not exactly match the finished edible print.
Screen settings vary between devices, and edible inks behave differently from conventional printing inks.
In particular:
- icing sheets usually produce brighter, more vivid colours;
- wafer paper tends to produce softer colours and may be slightly translucent.
Minor colour variations are therefore normal and are not considered defects.
15. Intellectual property
Unless otherwise stated, the content of the Blue Vanilla Designs website, including our original graphics, product photography, text, branding and website design, belongs to Creative Munch Ltd or is used with permission.
You may not copy, reproduce, distribute or commercially use our original content without permission.
Customer-supplied images remain the property of their respective owners.
Providing us with an image for an order gives us permission to use that image only as reasonably necessary to create and fulfil your order and deal with any related customer-service issue.
16. Our liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
Nothing in these terms affects your statutory rights as a consumer.
Subject to those rights, we are not responsible for losses caused by circumstances outside our reasonable control or for problems resulting from:
- incorrect personalisation supplied by the customer;
- unsuitable or low-resolution customer artwork;
- incorrect storage;
- incorrect application;
- an incorrect delivery address supplied by the customer; or
- reasonable variations in colour or appearance inherent in edible printing.
We do not exclude liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
17. Privacy and personal information
We use personal information in accordance with our Privacy Policy.
This includes information required to process your order, arrange delivery, communicate with you and create personalised products using details or images you supply.
Please see our Privacy Policy for more information about how we collect, use and protect personal information.
18. Events outside our control
We will not be responsible for failure or delay in performing our obligations where this is caused by an event outside our reasonable control.
Examples may include postal disruption, industrial action, severe weather, transport failure, utility outages, internet or hosting failures, natural disasters or other exceptional circumstances.
If such an event significantly affects your order, we will take reasonable steps to minimise the impact and contact you where appropriate.
19. Changes to these Terms & Conditions
We may update these Terms & Conditions from time to time to reflect changes to our products, website, business practices or legal requirements.
The version that applies to your order will normally be the version published on the website when your order is placed.
The latest version will show its most recent update date at the bottom of this page.
20. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections that apply where you live.
Nothing in these terms limits any rights you have under applicable consumer law.
